Cuando en 1892 se colocaban los hitos cordilleranos, Argentina objetó las disposiciones que se tomaban, exponiendo que el límite debía pasar "por las altas cumbres”, mientras que Chile, interpretando el espíritu y la letra del Tratado exponía que era "el de las más altas cumbres que dividan las aguas” o el "Divortium Aquarum". La línea de las altas cumbres que propiciaba Argentina en 1892 era una nueva posición de difícil aplicación, por cuanto podía cortar el curso de los ríos y de las vertientes, lo que no sucedía con la línea de las altas cumbres que dividen las aguas.
